TERMS & CONDITIONS
Last updated: 8 May 2026 · Effective: 8 May 2026
These Terms govern your use of HAMANI DOCS™, an AI-powered document drafting platform operated by HAMANI PTY LTD (ABN 73 277 932 893), a company registered in New South Wales, Australia.
By signing in, paying for credits, or using any feature of HAMANI DOCS, you agree to these Terms. If you don't agree, don't use the service.
1. What HAMANI DOCS is — and isn't
HAMANI DOCS helps everyday Australians draft, format, and understand documents using artificial intelligence. The service is for legitimate paperwork only.
What we help with:
- Filling empty forms with your own information
- Drafting letters, emails, complaints, applications, references and basic agreements
- Explaining or summarising documents in plain English
- Formatting tables, ledgers and simple invoices for your own business
What we do NOT provide:
- Legal, financial, tax, medical or migration advice
- Lodgement of forms with any government department
- Storage or hosting of government forms (we link to official .gov.au sources only)
- Verification, certification or notarisation of any document
- A substitute for a qualified lawyer, accountant, doctor or registered migration agent
2. Prohibited uses (strict)
You must not use HAMANI DOCS to:
- Edit, alter, fabricate, or back-date any bank statement, payslip, invoice, receipt, transaction record or other financial document
- Create, edit, or alter any identity document, including passports, driver's licences, Medicare cards, birth certificates, visas or proof-of-age cards
- Fabricate or alter any tax record, ATO document, payment summary, group certificate or notice of assessment
- Create or alter any medical certificate, prescription, doctor's note or hospital record
- Write a reference, recommendation or letter pretending to be someone else
- Impersonate any employer, landlord, doctor, lawyer, police officer or government official
- File or submit any false affidavit, statutory declaration, court document, or witness statement
- Make a fraudulent claim against Centrelink, the ATO, an insurer, a court, an employer or any other party
- Generate any document intended to deceive a person, business or government body
- Reverse engineer, scrape, mirror, or use automated tools to access HAMANI DOCS
- Resell, sublicense or commercially redistribute the service
- Upload content that is illegal, infringes copyright, or contains malware
- Upload personal information about anyone other than yourself, unless you have their explicit permission
HAMANI DOCS uses automated systems to detect and refuse such requests. If your input is flagged, the action will be cancelled and refunded. Repeated attempts will result in account suspension, and serious cases will be referred to law enforcement.
3. AI-generated output disclaimer
All output from HAMANI DOCS is AI-generated and must be treated as a draft. AI can and does make mistakes, including factual errors, legal misstatements, miscalculations, and outdated references.
You agree that:
- You will read, review and verify every output before relying on it
- You will not submit AI-generated text to any government, court, employer, insurer, or other third party without first checking it for accuracy
- For anything with legal, financial, medical or migration consequences, you will seek advice from a qualified professional before acting
- HAMANI PTY LTD is not liable for any loss, error, omission, refusal, penalty, fine, judgement or other consequence arising from your use of AI-generated output
HAMANI DOCS is a tool to help you draft. The decision to use, submit, or rely on what it produces is yours alone.
4. Your account and free actions
You sign in using a Google account. You must be at least 16 years old to use HAMANI DOCS. If you are under 18, you must have permission from a parent or guardian.
Each new account receives 2 free actions as a trial. After that, all actions are paid using credits you purchase. Free actions cannot be transferred, gifted, or accumulated.
5. Payments, credits and refunds
Pricing
HAMANI DOCS is pay-as-you-go. There are no subscriptions. Standard rate is A$0.85 per action. Pack pricing offers reduced per-action cost. Prices are displayed at the point of purchase and are inclusive of GST where applicable.
Payment processing
Payments are processed by Stripe Payments Australia Pty Ltd. Card details are never stored by HAMANI DOCS. By purchasing credits, you authorise Stripe to charge your nominated card.
Failed actions are refunded
If an action fails for technical reasons (server error, AI provider unavailable, etc.), the credit or free action is automatically refunded. You do not need to contact us.
Refund policy
Credits are non-refundable once consumed. Unused credits may be refunded within 14 days of purchase if you have not used the service substantially, by emailing support@hamanidocs.com.au with your account details.
Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) where to do so would be unlawful. Where our liability cannot be excluded, it is limited (at our option) to re-supply of the service or refund of the price paid.
6. Intellectual property and trademarks
Our marks
HAMANI™ is a trade mark of HAMANI PTY LTD asserted under common law and through use in trade. The mark HAMANI DOCS™, the HAMANI shield device, and the visual styling of this website are also trade marks and trade dress of HAMANI PTY LTD, asserted under common law and through use in trade. Trade mark applications with IP Australia may be filed in the future.
Reservation of rights
All software, code, design, content, layout, copy, illustrations and arrangement of the HAMANI DOCS website are © 2026 HAMANI PTY LTD. All rights reserved. You may not copy, reproduce, mirror, scrape, reverse-engineer or create derivative works of any part of the platform without prior written permission.
Government forms
HAMANI DOCS does not host, distribute or reproduce government forms. We provide a directory of links to official sources. All government forms remain the property of the issuing department and are subject to Crown Copyright.
Copyright takedown
If you believe content on HAMANI DOCS infringes your copyright or trade mark, email support@hamanidocs.com.au with: (a) a description of the work, (b) the URL where the alleged infringement appears, (c) your contact details, and (d) a statement that you have a good-faith belief the use is unauthorised. We will investigate within 7 business days.
7. Your content and uploaded files
You retain all rights to documents and information you upload or paste into HAMANI DOCS. By using the service you grant HAMANI PTY LTD a limited, non-exclusive licence to process that content solely to provide you with output, for the duration of your session.
Uploaded files are processed in memory and discarded immediately. We do not retain copies of your files. Your typed inputs and AI outputs are not stored beyond the operational logs needed to debug and bill.
Do not upload content that:
- Belongs to someone else and you don't have permission to use
- Contains personal information about a third party without their consent
- Is classified, confidential, or covered by professional privilege
- Contains malware or executable payloads
8. Limitation of liability
To the maximum extent permitted by law:
- HAMANI DOCS is provided "as is" and "as available" — without warranty of accuracy, fitness for purpose, uninterrupted availability, or freedom from defects
- HAMANI PTY LTD's total aggregate liability to you for any claim arising from or in connection with the service is limited to the total amount you paid HAMANI in the 6 months preceding the claim
- HAMANI PTY LTD will not be liable for indirect, consequential, incidental, special or exemplary damages, including loss of profit, business interruption, loss of data or loss of opportunity
- HAMANI PTY LTD will not be liable for any decision you make on the basis of AI output, or for any action taken or refused by a third party (including any government department) in response to a document produced with our help
This clause applies whether the claim is brought in contract, tort (including negligence), statute or otherwise. The Australian Consumer Law preservation in section 5 still applies.
9. Indemnity
You agree to indemnify and hold harmless HAMANI PTY LTD, its directors, employees and contractors from any claim, loss, demand, fine, penalty, judgement, legal cost or other liability arising from or in connection with:
- Your breach of these Terms (especially the prohibited uses in section 2)
- Your use of AI-generated output
- Content you upload or input
- Your interactions with any third party as a result of using HAMANI DOCS
10. Suspension and termination
We may suspend or terminate your account, with or without notice, if we reasonably believe you have:
- Breached any prohibited use
- Repeatedly attempted requests our refusal systems blocked
- Initiated a chargeback without first contacting support
- Used the service in a way that exposes HAMANI PTY LTD to legal or reputational risk
You may close your account at any time by emailing support. Unused credits older than 14 days are non-refundable upon voluntary closure unless required by law.
11. General terms
Governing law
These Terms are governed by the laws of New South Wales, Australia. The parties submit to the exclusive jurisdiction of the courts of New South Wales and the Federal Court of Australia.
Severability
If any clause of these Terms is found to be invalid or unenforceable, the remaining clauses continue in full force.
Force majeure
Neither party is liable for any failure or delay caused by events beyond its reasonable control, including AI provider outages, internet failures, natural disasters, government action, or pandemics.
Variation
We may update these Terms at any time. The "Last updated" date at the top will reflect when changes were made. Continued use of HAMANI DOCS after a change constitutes acceptance.
No waiver
Failure to enforce any clause of these Terms is not a waiver of our right to enforce it later.
Entire agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and HAMANI PTY LTD regarding HAMANI DOCS, and supersede any prior representations.
12. My Account Vault — data storage
HAMANI DOCS provides a personal information storage feature ("My Account Vault") with two parts:
- Personal information form — a structured form (name, contact, address, employment, emergency contact, basic health) that pre-fills HAMANI tools when you ask it to.
- Document upload vault — a private file store for documents you choose to upload (e.g. licence scan, Medicare card, bank statement).
By using the Vault you acknowledge:
- HAMANI PTY LTD is the data controller under the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Google LLC operates the underlying Firestore and Firebase Storage infrastructure as our data processor, with data stored in the
australia-southeast1 region.
- Reasonable security measures. We implement reasonable technical and organisational measures appropriate to the sensitivity of the information, including encryption in transit (TLS), encryption at rest at the infrastructure layer, a 4-digit PIN gate on top of Google sign-in, server-side PIN hashing (PBKDF2-SHA-256, 100,000 iterations, per-user salt), rate limiting on PIN attempts, and immutable audit logs.
- Limits of the PIN. The PIN is a user-experience friction layer to reduce the risk of casual access on a shared device. It is not, on its own, encryption of your data. Your sensible custody of your Google account and your PIN materially affects the security of your Vault.
- PIN recovery. If you forget your PIN, you can reset it by re-authenticating with Google. We cannot recover a forgotten PIN by any other method, by design.
- Notifiable Data Breach scheme. If we become aware of an eligible data breach involving your Vault information, we will assess and notify you and the Office of the Australian Information Commissioner (OAIC) as required under the Privacy Act 1988 (Cth) Part IIIC (Notifiable Data Breaches scheme), within the statutory timeframes (we aim for notification as soon as practicable and, where practicable, within 72 hours of confirming an eligible breach).
- Your responsibilities. You are responsible for the accuracy of information you enter, for keeping your Google account secure, for not sharing your PIN, and for ensuring you have the right to upload any document you place in the Vault.
- Your ownership and control. You retain full ownership of your Vault contents. You may export your data at any time via Account → Download my data, and you may delete your account (and all Vault contents) via Account → Danger Zone → Delete account. Deletion is soft for 30 days, then permanent.
- Phase 2 fields (deferred). Tax File Number, passport number, and bank account/BSB fields are intentionally not collected in this version pending legal review. Where these fields are required by a form, HAMANI will prompt you to enter them at form-fill time only.
Nothing in this section limits or excludes any consumer guarantee under the Australian Consumer Law, any right or remedy under the Privacy Act 1988 (Cth), or any other right or remedy you have at law.
